University of Texas at Austin<\/a><\/em> decision. In its decision, a nearly unanimous court stated the lower appellate court (United States Court of Appeals for the Fifth Circuit) failed to apply the correct standard of review to its review of the University of Texas&#8217; affirmative action admissions policy.&nbsp; Therefore, the Court vacated the lower court&#8217;s decision and remanded it to that court for action consistent with the Court&#8217;s decision.<\/p>\n<p>&#8216;Puter has the following quick, pithy thoughts on the Fisher decision, as he waits with bated breath for the Court&#8217;s remaining decisions to issue, which may occur as early as this morning at 10:00 AM.<\/p>\n<div style=\"line-height: normal; margin: 0in 0in 0pt 0.5in; mso-add-space: auto; mso-list: l0 level1 lfo1; text-indent: -0.25in;\"><!--[if !supportLists]--><span style=\"font-family: Symbol; font-size: 10pt; mso-bidi-font-family: Symbol; mso-fareast-font-family: Symbol;\"><span style=\"mso-list: Ignore;\">\u00b7<span style=\"font-size-adjust: none; font-stretch: normal; font: 7pt\/normal &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><!--[endif]--><span style=\"font-family: &quot;Georgia&quot;,&quot;serif&quot;; font-size: 10pt;\">Justice Kennedy\u2019s majority opinion was joined in full by Chief Justice Roberts and Justices Scalia, Thomas, Breyer, Alito and Sotomayor. The Court\u2019s decision should be non-controversial, as it was joined by profoundly conservative Justices and proudly liberal Justices alike.<o:p><\/o:p><\/span><\/div>\n<p><\/p>\n<div style=\"line-height: normal; margin: 0in 0in 0pt 0.5in; mso-add-space: auto; mso-list: l0 level1 lfo1; text-indent: -0.25in;\"><!--[if !supportLists]--><span style=\"font-family: Symbol; font-size: 10pt; mso-bidi-font-family: Symbol; mso-fareast-font-family: Symbol;\"><span style=\"mso-list: Ignore;\">\u00b7<span style=\"font-size-adjust: none; font-stretch: normal; font: 7pt\/normal &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><!--[endif]--><span style=\"font-family: &quot;Georgia&quot;,&quot;serif&quot;; font-size: 10pt;\">The <i style=\"mso-bidi-font-style: normal;\">Fisher<\/i> opinion is conservative. The Court decided the fewest issues necessary to reach a result.<span style=\"mso-spacerun: yes;\">&nbsp; <\/span>That is, rather than reach the issue of affirmative action itself (which arguably was not properly before the Court), the Court determined only that the lower court did not properly apply the appropriate standard of review, strict scrutiny.<o:p><\/o:p><\/span><\/div>\n<p><\/p>\n<div style=\"line-height: normal; margin: 0in 0in 0pt 0.5in; mso-add-space: auto; mso-list: l0 level1 lfo1; text-indent: -0.25in;\"><!--[if !supportLists]--><span style=\"font-family: Symbol; font-size: 10pt; mso-bidi-font-family: Symbol; mso-fareast-font-family: Symbol;\"><span style=\"mso-list: Ignore;\">\u00b7<span style=\"font-size-adjust: none; font-stretch: normal; font: 7pt\/normal &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><!--[endif]--><span style=\"font-family: &quot;Georgia&quot;,&quot;serif&quot;; font-size: 10pt;\">Liberals incorrectly claim the <i style=\"mso-bidi-font-style: normal;\">Fisher<\/i> decision is a vindication of affirmative action in college admissions.<span style=\"mso-spacerun: yes;\">&nbsp; <\/span>Liberals are wrong for two main reasons. <o:p><\/o:p><\/span><\/div>\n<p><\/p>\n<div style=\"line-height: normal; margin: 0in 0in 0pt 1in; mso-add-space: auto; mso-list: l0 level2 lfo1; text-indent: -0.25in;\"><!--[if !supportLists]--><span style=\"font-family: &quot;Courier New&quot;; font-size: 10pt; mso-fareast-font-family: &quot;Courier New&quot;;\"><span style=\"mso-list: Ignore;\">o<span style=\"font-size-adjust: none; font-stretch: normal; font: 7pt\/normal &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><!--[endif]--><span style=\"font-family: &quot;Georgia&quot;,&quot;serif&quot;; font-size: 10pt;\">First, as noted above, the Court avoided reaching the ultimate issue of whether government can use race as a factor in college admissions determinations to the detriment of others. <o:p><\/o:p><\/span><\/div>\n<p><\/p>\n<div style=\"line-height: normal; margin: 0in 0in 0pt 1in; mso-add-space: auto; mso-list: l0 level2 lfo1; text-indent: -0.25in;\"><!--[if !supportLists]--><span style=\"font-family: &quot;Courier New&quot;; font-size: 10pt; mso-fareast-font-family: &quot;Courier New&quot;;\"><span style=\"mso-list: Ignore;\">o<span style=\"font-size-adjust: none; font-stretch: normal; font: 7pt\/normal &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><!--[endif]--><span style=\"font-family: &quot;Georgia&quot;,&quot;serif&quot;; font-size: 10pt;\">Second, at least two Justices (Thomas and Scalia) strongly indicated that when the case returns to the Court on appeal, they will vote to hold affirmative action programs as unconstitutional.<span style=\"mso-spacerun: yes;\">&nbsp; <\/span>Chief Justice Roberts has already said \u201cthe way to stop discriminating on the basis of race is to stop discriminating on the basis of race.\u201d Justice Alito is likely a fourth vote to overturn affirmative action.<span style=\"mso-spacerun: yes;\">&nbsp; <\/span>All the Fisher decision did was to delay affirmative action\u2019s day of reckoning.<o:p><\/o:p><\/span><\/div>\n<p><\/p>\n<div style=\"line-height: normal; margin: 0in 0in 0pt 0.5in; mso-add-space: auto; mso-list: l0 level1 lfo1; text-indent: -0.25in;\"><!--[if !supportLists]--><span style=\"font-family: Symbol; font-size: 10pt; mso-bidi-font-family: Symbol; mso-fareast-font-family: Symbol;\"><span style=\"mso-list: Ignore;\">\u00b7<span style=\"font-size-adjust: none; font-stretch: normal; font: 7pt\/normal &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><!--[endif]--><span style=\"font-family: &quot;Georgia&quot;,&quot;serif&quot;; font-size: 10pt;\">Conservatives should not be disappointed with the <i style=\"mso-bidi-font-style: normal;\">Fisher<\/i>decision. Sure, it would\u2019ve been great to have the Court drive a stake through the heart of affirmative action at long last.<span style=\"mso-spacerun: yes;\">&nbsp; <\/span>But in refusing to do so, the Court has shown judicial restraint on an issue near and dear to liberal hearts. Expect Chief Justice Roberts to use this as a cudgel on the Court\u2019s liberal wing the next time it wants to issue an overreaching decision on climate change, disparate impact analysis or gay rights.<o:p><\/o:p><\/span><\/div>\n<p><\/p>\n<div style=\"line-height: normal; margin: 0in 0in 0pt 0.5in; mso-add-space: auto; mso-list: l0 level1 lfo1; text-indent: -0.25in;\"><!--[if !supportLists]--><span style=\"font-family: Symbol; font-size: 10pt; mso-bidi-font-family: Symbol; mso-fareast-font-family: Symbol;\"><span style=\"mso-list: Ignore;\">\u00b7<span style=\"font-size-adjust: none; font-stretch: normal; font: 7pt\/normal &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><!--[endif]--><span style=\"font-family: &quot;Georgia&quot;,&quot;serif&quot;; font-size: 10pt;\">Even if affirmative action should survive its next encounter with the Court, the <i style=\"mso-bidi-font-style: normal;\">Fisher<\/i> decision has severely limited its usefulness. The Court insisted that colleges are entitled to zero deference as to the necessity of the means used to achieve racial diversity. In the Court\u2019s words, \u201cRace may not be considered unless the admission process can withstand strict scrutiny.\u201d<o:p><\/o:p><\/span><\/div>\n<p><\/p>\n<div style=\"line-height: normal; margin: 0in 0in 0pt 0.5in; mso-add-space: auto; mso-list: l0 level1 lfo1; text-indent: -0.25in;\"><!--[if !supportLists]--><span style=\"font-family: Symbol; font-size: 10pt; mso-bidi-font-family: Symbol; mso-fareast-font-family: Symbol;\"><span style=\"mso-list: Ignore;\">\u00b7<span style=\"font-size-adjust: none; <\/span>Read them a few of these quotes, then ask your addlepated interlocutor what makes her (it\u2019s usually a her) think a current affirmative action based admissions program can withstand this standard of review.<o:p><\/o:p><\/span><\/div>\n<p><\/p>\n<div style=\"line-height: normal; Liberal do-gooders no longer can hide behind the wink-and-a-nod understanding that racial discrimination is fine so long as it only hurts Whitey T.
